Who is Notary Public?

Notary Public is an official of integrity appointed by state government — typically by the secretary of state — to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. Notary's duty is to screen the signers of important documents for their true identity, their willingness to sign without duress or intimidation, and their awareness of the contents of the document or transaction. Some notarization is under oath and penalty of perjury. As official representative of the state, a Notary is impartial and follows set rules and guidelines without exercising personal discretion. A Notary is duty-bound not to act when there is self-interest or corruption.

What can a Notary do?

The process of authentication of the signature is referred to as notarization or notarial act. A Notary certifies proper execution of life changing events of private citizens. A Notary can notarize identification, educational, financial, documents, power of attorneys, premarital and marital agreements, conveyance of real property, and perform the multitude of other activities that enable our civil society to function.

A U.S. Notary Public is not an attorney, Judge, or high-ranking official as is some countries and cannot give legal advice or assist in immigration process.

How is Notarization done?

Notarization requires personal appearance of the signer and a valid photo ID - driver's license, passport, or other government issued IDs. Notary will make sure the signer is acting on their free will, not being coerced into signing. Notary will also make sure of signer's awareness, that is, signer understands what is happening and what you're signing. Notary will visually check for completeness of the document. If you are intoxicated, medicated, or unable to understand what's happening or what you are signing or is incomplete, Notary will refuse signing. If all is well, Notary will record the notarization in the Notary journal and complete the Notarial certification.
